1. You must select and retain Chazy Westport communications as your local telephone provider. Plan includes domestic direct-dialed calls to anywhere in the Continental US. Customers with an outstanding balance past 60 days or more are not eligible. Telephone line charge, taxes and other fees apply. Additional terms and conditions apply.

2. Chazy Westport Communications residential local telephone service is required for full term. All rates listed above are subject to change without notice and are contracted rates only. In order to receive this bundled discount, user must maintain all bundled services required and agree to an available term option above. Rates vary by region and are residential rates only.

3. The unlimited plans detailed herein are designed for the calling habits of the typical residence. In some cases, if Chazy Westport Communications finds that certain users have requirements over and above what the industry accepts as typical residential usage, we reserve the right to cancel your unlimited calling plan. When pricing our plans, we have to consider the average consumer and cannot allow usage that would be typical for a business, call center, telemarketing firm or other high volume user. Customer must maintain consistent, on time payments or the plan can be removed or suspended from the account.

4. The service is provided to Customer as an individual user, for your personal, residential, non-business and non-professional use. This means that Customer are not to use it for any commercial or governmental activities, profit-making or non-profit, including but not limited to home office, business, sales, telecommuting, telemarketing (including without limitation charitable or political solicitation or polling), autodialing, continuous or extensive call forwarding, fax broadcast, fax blasting or any other activity that would be inconsistent with normal individual usage patterns. This also means that Customer are not to resell or transfer the service to any other person for any purpose, or make any charge for the use of the service, without express written permission from our company. Customer agree that your use of the service provided to Customer by any other person for any business or governmental purpose will obligate Customer to pay the higher rates for business service on account of all periods, including past periods, in which Customer use, or used, the service for business or governmental purposes. Chazy Westport Communications reserves the right to immediately terminate or modify the service, if we determine, in our sole discretion, that Customer's service is being used for non-individual or business use.

5. For monthly plan users the service is provided on a monthly basis and is paid in advance for each month. The monthly plan activation date is deemed the anniversary date. The monthly plan will renew each month on the anniversary date unless terminated by the customer. Notice of termination must be in writing via email to our email address of record 90 days prior to the anniversary date, at which time retroactive charges, promotions, installation or equipment costs may apply.

6. Monthly plan fees will not be prorated and/or refunded for the termination month. Notice of termination received after the required notice date will be effective for the next anniversary date. A setup fee will be charged to reactivate plans that were previously terminated. Requests to upgrade or downgrade a monthly calling plan to a different calling plan must be submitted in writing and to the email address of record. Request to change an existing plan must be submitted at least five days prior to the monthly anniversary date. Requests to upgrade or downgrade a monthly plan are not automatic and are subject to approval by Our Company. Existing monthly plan customers that receive approval from to change to a more expensive (upgrade) monthly plan may do so without having to pay another setup fee. Existing monthly plan customers that receive approval to change to a less expensive (downgrade) monthly plan may do so and will be required to pay another setup fee.

7. Chazy Westport Communications may change the terms and conditions this Agreement from time to time and at its discretion without prior notice. Chazy Westport Communications reserves the right to change, suspend or cancel the service, temporarily or permanently, with or without notice to the customer. Chazy Westport Communications will not be liable to the customer or any third party in the event that we exercise our right to modify or discontinue the service.

8. Any telephone number provided (the Number) to the customer shall be leased and not sold to the customer. The customer shall not obtain any rights, title or interest in the Number. The customer is not to use the Number with any other device other than the approved equipment (the Equipment) without the express written permission of our company. Chazy Westport Communications reserves the right to change, cancel or move the Number at its discretion. Upon expiration, cancellation or termination of the service, the customer shall permanently relinquish and discontinue use of any phone numbers, voice mail access numbers and/or web portals assigned to the customer by our company.

9. Service commitments are auto-renewing on an annual basis in order to maintain bundles, discounts or service availability. Should you wish to cancel any agreement with Chazy Westport Communications, notification is required 90 days prior to service termination, Chazy Westport Communications reserves the right to make rate changes and adjustments. Contract agreements are necessary for us to deliver reliable, cost effective service, but can not guarantee rates, as many costs are out of Chazy Westport Communications’ control.

10. If the customer is receiving Broadband Internet Access from Chazy Westport Communications, it is recommended that the customer acquire and install Firewall or other Internet Security device, as well as surge protection, as we cannot be held liable for damaged modems, computers, phones or any other electronic equipment.

I may be charged additional fees involved in disconnection or account changes including $195 penalty, as well as retroactive reimbursement for discounted rates. I understand my monthly-billed rate does not include any equipment charges; taxes, fees, surcharges, additional calling features and long distance above included free minutes if so apply.
